Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Eko Edit Android application operated by Eko Systems LLC ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

The App is available to users aged 16 and older in the United States and Canada. Users under 16 may not use the App. By using Eko Edit, you represent that you are at least 16 years old and located in the United States or Canada.

All users aged 16 and older have access to AI features. The AI provider depends on age and connectivity:

  • Users under 18: all AI features (auto-tagging, receipt scanning, outfit import) use on-device processing via Google ML Kit only. No data is sent to the Google Gemini API.
  • Users 18 and older (online): AI features use the Google Gemini API for enhanced cloud-based capabilities.
  • Users 18 and older (offline): the App automatically falls back to on-device ML Kit processing.
  • Users 18 and older (online, with ≥ 10 closet items): can access the AI Stylist — a conversational outfit-suggestion assistant — either with an active Premium subscription (unlimited access) or as a free-tier user by watching a rewarded video ad (limited session of up to 8 turns).

2. Description of Service

Eko Edit is a personal wardrobe management application for Android. It allows you to catalog clothing items, scan receipts using AI, log outfits to a calendar, and gain insights into how you use your wardrobe. Free and Premium subscription tiers are available.

We reserve the right to modify, suspend, or discontinue features of the App at any time with reasonable notice.

3. Acceptable Use

You must use Eko Edit for its intended purpose: personal wardrobe management. The App provides cloud storage, photo storage, and AI features specifically to support wardrobe cataloging and outfit tracking.

Prohibited Uses

  • Using photo or file storage as a general-purpose cloud storage system by uploading content unrelated to clothing items or receipts.
  • Uploading excessive volumes of photos or data with no wardrobe-management purpose, in a manner that constitutes storage abuse.
  • Attempting to reverse-engineer, scrape, or otherwise abuse the App's APIs or backend services.
  • Creating multiple accounts to circumvent free-tier limits (item caps, receipt scan quotas).
  • Using AI features to generate, distribute, or promote harmful, offensive, or misleading content.
  • Using the AI Stylist to attempt to solicit advice on topics unrelated to clothing, styling, occasions, or weather. The feature is restricted by design; attempts to circumvent the topic restriction do not constitute a breach of these Terms on their own, but repeated abuse may result in feature access being suspended.
  • Impersonating other users or misrepresenting your identity.
  • Any use that violates applicable local, state, or federal laws.

Enforcement

Accounts found to be in violation of these Terms — for example, accounts using the App primarily as a general-purpose file storage service rather than for wardrobe management — may be:

  • Warned via the email address on the account,
  • Have specific features or storage access temporarily restricted, or
  • Have the account deactivated or permanently deleted.

We will make reasonable efforts to notify you before taking action, except where immediate action is required to protect the App or other users.

4. AI-Generated Content & Manual Override

Eko Edit uses AI to generate outfit suggestions, wardrobe auto-tags, and receipt parsing results. The AI provider depends on the user's age and connectivity: Google Gemini API is used for users aged 18 and older when online; Google ML Kit (on-device) is used for users under 18 and as a fallback for users 18+ when offline. AI-generated content is provided as-is and may not always be accurate, complete, or appropriate.

The AI Stylist generates outfit recommendations through a guided conversation. All suggestions are based solely on items in your wardrobe. Gemini may occasionally produce suggestions that do not perfectly match your preferences or wardrobe reality — always exercise your own judgement before deciding what to wear. Marking an outfit as "worn today" is a manual action you control; the App will not log wear events without your explicit confirmation. All AI Stylist responses are identified as AI-generated within the app interface. A disclosure notice is displayed at the start of every session.

The following categories of content cannot be generated by the AI Stylist and attempts to elicit them are a violation of these Terms: sexually explicit or suggestive content; content that harasses or demeans any person or group; content that facilitates dangerous or illegal activities; and content related to elections or political candidates.

The Photo Cleanup feature uses Google MediaPipe's on-device subject segmentation model to remove photo backgrounds locally. No photo data is transmitted to any server for this feature, and it is available regardless of age or connectivity.

AI Stylist — Age and Access Requirements

The AI Stylist feature is available to users aged 18 and older with at least 10 active items in their closet. The age requirement is enforced via Google Play Age Signals. If you are under 18, the feature will not be accessible regardless of your subscription status. Premium subscribers have unlimited access; free-tier users may access one limited session (up to 8 conversation turns) per rewarded video ad watched.

Reporting AI Content

If you believe any AI-generated content is inaccurate, inappropriate, or harmful, you can report it using the in-app report feature (available on individual AI Stylist message bubbles and on other AI-generated content throughout the App). We take all reports seriously and review them promptly.

Manual Override & Escalation Process

If you have reported AI-generated content through the App and are unsatisfied with the response or outcome, you may escalate the review by emailing support@theekosystems.com with the subject line "AI Content Escalation."

We review all escalated AI content reports within 48–72 hours of receipt and will respond with the outcome of our human review. This process ensures human accountability for all AI-generated content in the App.

5. Subscriptions & Billing

Premium subscriptions (Monthly or Yearly) are managed entirely via Google Play Billing. All payment processing, billing cycles, and refund eligibility are governed by Google Play's terms and policies. Eko Systems LLC does not directly handle or store any payment card information.

Recurring subscriptions (Monthly and Yearly) will automatically renew at the end of each billing period unless cancelled. Cancellations take effect at the end of the current billing period — you will retain Premium access until that date. To cancel, use the Google Play subscription management interface.

Free trial eligibility: A 10-day free trial may be offered to first-time subscribers only. If you have previously held a Monthly or Yearly Premium subscription under the same Google account — regardless of whether it was cancelled, lapsed, or refunded — you are not eligible for a free trial on any subsequent subscription. The free trial offer is determined by Google Play and will not be presented in the app's purchase flow for ineligible accounts.

Refunds are subject to Google Play's refund policy. Contact Google Play support for refund requests.

Downgrade and Data Retention

When your Premium subscription ends — whether cancelled voluntarily, due to non-renewal, or because of a failed payment — the following grace-period policy governs your Premium data:

  • Days 1–30 (Grace Period): Your receipt image archive transitions to a read-only state. You can still view the purchase history list (store, date, price, and linked item names), but receipt images are locked behind a Premium upsell prompt. All other Premium features (unlimited items, full lookbook, cloud backup, AI Stylist — conversational outfit suggestions for users 18 and older) are suspended immediately at the end of your billing period.
  • Future Outfit Plans (Lookbook): Any outfit plans you logged for future dates (Day +2 or later) become read-only. You can still view the planned outfits but cannot add, edit, or remove items until you re-subscribe.
  • Days 31–90 (Final Notice): Your receipt archive remains in read-only mode. We will send in-app notifications and, if you have opted into email communications, email reminders informing you that permanent deletion is approaching.
  • Day 90+: Receipt image files are permanently deleted from cloud storage. Purchase history metadata stored locally on your device (store name, date, item titles, cost) is retained and not deleted. Re-subscribing after Day 90 restores full Premium features but cannot recover deleted receipt images.

This grace-period policy exists to protect users from accidental data loss caused by expired payment methods or unintentional lapses. It does not constitute a guarantee of continued access to Premium features during the grace period.

Referral Program

Eko Edit offers a referral program that rewards existing users when a new user installs the App through their referral link and completes a qualifying action. Referral rewards (such as additional free-tier item slots) are attributed automatically via the Google Play Install Referrer API.

  • Genuine new install required: rewards are granted only when a first-time installer completes a qualifying action (e.g. account registration). Installing the App on a device where it was previously installed, or creating duplicate accounts to generate referrals, does not qualify.
  • Rewards subject to change: referral reward tiers and conditions may be modified or discontinued at any time. Changes apply to future referrals only.
  • No cash value: referral rewards have no monetary value and cannot be exchanged for cash or applied as credit against a subscription purchase.

6. Intellectual Property

The App, its design, code, branding, and all content created by Eko Systems LLC are owned by Eko Systems LLC and protected by applicable intellectual property laws.

Content you create within the App — including wardrobe item data and photos you upload — remains yours. By using the App, you grant Eko Systems LLC a limited, non-exclusive license to store, process, and display that content solely to provide the App's features to you. This license ends when you delete your account.

7. Privacy & Data Deletion

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect and use your data.

You may request deletion of your data at any time through two options:

  • Data deletion (keep account): permanently removes all wardrobe data (clothing items, photos, outfit logs, receipt records, wear statistics, and cloud backups) while leaving your sign-in credentials and subscription intact. Available via Settings → Support & Privacy → Request Data Deletion in the App, or at theekosystems.com/ekoedit/delete-account.
  • Full account deletion: permanently removes all data listed above plus your account credentials. Available via Settings → Support & Privacy → Delete All My Data in the App, or via the same page above.

All deletion requests are processed within 30 days of submission.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

AI-generated content (auto-tags, receipt extractions, outfit suggestions) is produced by automated systems and may contain errors. You are responsible for verifying AI-generated output before relying on it.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Eko Systems LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid to Eko Systems LLC in the twelve (12) months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Pinellas County, Florida.

11. International Data Transfers (Canadian Users)

If you are a resident of Canada, please note that your personal information is transferred to, stored, and processed in the United States on Google Cloud Platform infrastructure. By using the App, you acknowledge and consent to this transfer. Your data may be subject to U.S. laws, which may differ from Canadian privacy laws. For full details, see our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via an in-app notice or the email address associated with your account. Continued use of the App after the effective date of updated Terms constitutes acceptance of the changes.
